Chartered Application – Terms and
Conditions

These terms and conditions form the basis of the contract through which the Chartered Institute for the Management of Sport and Physical Activity (“CIMSPA”, “We” or “Us”) will deliver a service to you as a CIMSPA Chartered Applicant (“You”). On submission of a Chartered Application Form You are agreeing to these terms and conditions, therefore it is Your responsibility to fully read and understand the terms and conditions before applying. If You have any questions or require clarification on any of the points outlined, please contact CIMSPA via the contact channels highlighted above.

These terms and conditions are binding throughout the chartered application process, which ends either at the point Your chartered status is confirmed by Us in writing to You or when You confirm Your withdrawal from the chartered assessment process to Us in writing.

CIMSPA will handle all data in accordance with Our privacy notice and data retention schedule which can be found here.

1. Member terms and conditions

You are also bound by the Member terms and conditions which are available here . In the event of any inconsistency between these terms and conditions and the Member terms and conditions, the Member terms and conditions shall prevail.

2. Chartered applications

Upon completion of an online Chartered Application Form, or upon submission of written details to support an application made by email, You are making an application to become Chartered, and an application for CIMSPA membership if You are not a current, active CIMSPA member. Once received by CIMSPA, this will result in a legally binding contract.

Chartered status will only be granted to individuals who are able to evidence that they satisfy the requirements for the relevant Chartered category at the time of application. These requirements are at the discretion of CIMSPA and are subject to change without prior notice.

The rights and obligations under these terms and conditions are restricted solely to You and cannot be transferred to another individual.

3. Application fees and cooling-off period

3.1 Individuals

The chartered application fee must be paid in full, at the point of or prior to the submission of Your Chartered Application Form. Payment can be made via BACS or through the Chartered Application Form.

The chartered application fee is non-refundable subject to any Cooling-Off Periods being honoured as outlined in Clause 3.3 below.

The current chartered application fee is available on Our website and will be confirmed during Your initial call with a CIMSPA staff member following Your expression of interest in applying for chartered status.

3.2 Corporate

If Your application is funded by a CIMSPA Partner, the application will be put ‘on hold’ until payment has been made.

3.3 Cooling-off period

When You submit an application for chartered status, You enter into a contract with Us to supply You a service. You have the right to a 14-day cooling-off period, which will start the day after You submit Your Chartered Application Form (“the Cooling-Off Period”).

3.4 Cancellations

If You choose to request a cancellation within the Cooling-Off Period, You will be entitled to a refund of the chartered assessment fee. To be eligible to cancel Your application, You must notify Us within the 14-day cooling-off period by email to info@cimspa.co.uk.

For cancellation requests made within the 14-day cooling-off period, any fees paid will be refunded in full to the original payment method, within 30 days from receipt of Your request to cancel Your application.

Requests for cancellations made outside of the 14-day cooling-off period will not be eligible for a refund of the fees paid.

4. Assessment process

The process for assessment for chartered status is outlined in the Chartered Candidate Guide. This will be provided to You following Your initial call with a CIMSPA staff member to discuss Your expression of interest in applying for chartered status.

Each unit’s individual criteria is assessed on a Pass or Refer basis.

To be awarded chartered status You must receive a confirmed Pass for every criteria.

4.1 Referred criteria

If You receive a Refer for one or more criteria then then You will be directed through the Referral process. This may include but is not limited to:

  • Request for additional evidence to be uploaded to Your evidence portfolio
  • Reassessment

You will be made aware of any additional fees at this point. Your Referral will not be progressed until payment is received, and You have the right to a 14-day cooling-off period, which will start the day after payment is made. There is no additional fee for being required to upload additional evidence to Your evidence portfolio.

4.2 Submission of evidence

At all times it is Your responsibility to submit such information as CIMSPA requires You to provide in support of a chartered application, including but not limited to as part of Your evidence portfolio, any supplementary evidence following Your assessment, or any additional evidence to support reassessment of a Referred criteria.

The Chartered Candidate Guide contains deadlines relating to Your chartered application process. Throughout Your chartered application process, You may be asked to submit additional evidence that may not be covered within the Chartered Candidate Guide, however You will be provided with notice of any such deadlines at the point the additional evidence is requested. Where any deadlines are not met by You, We reserve the right to close Your application and no refund will be provided.

By submitting information in support of Your chartered application, You grant CIMSPA the right to share any such information with Your Chartered Assessor, with one of more of Our Independent Verifiers if appropriate, and with any other relevant third parties for the purpose of verification of the validity of the information You provide to Us.

4.3 Additional support

CIMSPA has the following policies in place:

  • Special Consideration

These are available upon request.

4.4 Appeals

Should You feel We have failed to follow due process or there has been procedural defect in Your Chartered application, You are able to raise this with Us through Our formal appeals process.

5. Chartered membership subscription fees

If Your chartered status is confirmed in writing by Us, Your Chartered membership subscription fees will become due and You will receive an invoice from Us detailing the amount due and how to pay.

If You are not a current CIMSPA member, Your membership commencement date will be the date Your chartered status is confirmed in writing by Us.

If You are a current CIMSPA member, You will be subject to paying the pro-rata upgrade fees for the difference in fees for the remainder of Your subscription year. This payment can only be paid manually and cannot be added to any live Direct Debit mandate.

Once Your chartered status is confirmed in writing by Us, these terms and conditions no longer apply but You will continue to be bound by the Member terms and conditions.

6. Data protection

We will only process personal information You give Us in accordance with the applicable data protection laws and the CIMSPA Privacy Notice. You can view Our full Privacy Notice and Data Retention Schedule here. These include information on how We protect Your information and how to exercise any of Your rights in relation to it.

By submitting information in support of Your application for chartered status, You grant CIMSPA the right to share any such information with relevant third parties for the purpose of verification of the validity of the information You provide to Us.

7. Artificial intelligence

CIMSPA may utilise artificial intelligence (AI) tools and algorithms to enhance user experience, analyse data and improve decision-making processes. All AI-driven processes will adhere to applicable UK data protection laws, including the General Data Protection Regulation (GDPR). While AI can assist in improving services, final decisions will be subject to human oversight where appropriate.

8. Terms and conditions changes

CIMSPA reserves the right to change the provisions of these terms and conditions at any time by giving You at least 14-days prior written notice by email, following which time (unless You have notified Us that You do not accept the amendments) the amended version will become binding.

If You do not accept the amended terms and conditions, You may cancel Your chartered application and access a pro-rata refund by providing notice of Your intent to cancel to CIMSPA, in writing by email to info@cimspa.co.uk, within 14 days from notice of the changes to the terms and conditions being sent to You.

9. Liability

CIMSPA shall have no liability to an applicant or a member in respect of a failure to carry out or delay in carrying out any of CIMSPA’s obligations under these terms and conditions caused by any circumstances outside Our reasonable control.

Except in the case of fraud, death or personal injury caused by Our negligence or other cases where by law liability cannot be excluded or limited, We exclude all liability to You in respect of Your application for chartered status, or any information or other content obtained either directly or indirectly as a result of Your application for chartered status, howsoever arising, in any circumstances and whether in contract, tort, negligence, misrepresentation or otherwise.

Under no circumstances shall We have any liability for any loss of profit, business opportunity, goodwill, anticipated savings or data, or for any special, indirect, incidental or consequential loss or damages of whatsoever kind resulting from Your application for chartered status, or any information or other content obtained either directly or indirectly as a result of Your application for chartered status, howsoever arising, in any circumstances and whether in contract, tort, negligence, misrepresentation or otherwise.

10. Governing law and jurisdiction

These terms and conditions are governed by and will be construed in accordance with English law. Any dispute or claim must be brought before the English courts irrespective of an individual’s location.
